TERMS OF SERVICE

1. Acceptance of Terms

By downloading, installing, or playing Ironsight (the "Game"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Game. These Terms form a legally binding agreement between you and HMT Eskeland ("we", "us", or "our").

2. License Grant

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, non-commercial license to download and use the Game on devices you own or control, solely for your personal entertainment purposes. This license does not include the right to sublicense, sell, resell, copy, modify, or distribute the Game or any portion of it.

3. In-App Purchases

The Game offers optional in-app purchases including gems, starter packs, and the Battle Pass. All purchases are processed by Apple through the App Store and are subject to Apple's payment terms. We do not process payments directly.

• All in-app purchases are final and non-refundable, except where required by applicable law or Apple's refund policy.
• Virtual currency and items purchased have no real-world monetary value and cannot be exchanged for cash.
• We reserve the right to modify, discontinue, or rebalance in-game items and currencies at any time.

4. User Conduct

You agree not to engage in any of the following prohibited activities:

• Cheating, exploiting bugs, or using unauthorised third-party software to gain an unfair advantage
• Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the Game
• Modifying, adapting, translating, or creating derivative works based on the Game
• Using the Game for any commercial purpose without our express written consent
• Attempting to gain unauthorised access to our servers, systems, or other users' accounts

5. Intellectual Property

The Game and all content within it — including but not limited to graphics, characters, animations, music, sound effects, code, and user interface designs — are owned by HMT Eskeland and are protected by Norwegian and international intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property beyond the limited license described in Section 2.

6. Termination

We reserve the right to suspend or terminate your access to the Game at any time, with or without notice, if we determine that you have violated these Terms or engaged in conduct we deem harmful to other users, the Game, or our business. Upon termination, your license to use the Game is immediately revoked. Virtual items or currency associated with your account will not be refunded upon termination for cause.

7. Disclaimer of Warranties

The Game is provided "as is" and "as available" without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, HMT Eskeland shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Game, including loss of data, loss of profits, or loss of virtual items. In jurisdictions that do not allow the exclusion of certain damages, our liability shall be limited to the minimum amount permitted by law. Our total aggregate liability to you shall not exceed the amount you paid for in-app purchases in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Norway.

10. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes by updating the effective date and, where appropriate, by notice within the Game. Continued use of the Game after changes are posted constitutes your acceptance of the updated Terms.
